Consent to immediate digital service delivery

Information and consent wording for **consumers** purchasing a ProperSend subscription at a distance. SaaS is digital content not supplied on a tangible medium — explicit consent to immediate performance is required before access starts (Polish Consumer Rights Act Art. 38(13) equivalent). Current consent text version: **2026-06-13-v1**.

1. When this applies

At ProperSend subscription checkout when the buyer may be a consumer (natural person acting outside their trade/business).

B2B customers accept Terms and DPA separately — see /regulamin and /umowa-powierzenia.

2. Pre-contract information

Before consent, the consumer receives:

  • ProperSend service description (online SaaS);
  • price, billing period, payment method;
  • notice that after starting use they lose the right of withdrawal (where applicable);
  • links to Terms (/regulamin) and Privacy Policy (/polityka-prywatnosci);
  • complaints procedure (/zwroty-reklamacje).

3. Checkout checkbox wording

At payment we show a separate checkbox:

“I consent to immediate start of the ProperSend digital service before the 14-day withdrawal period ends. I acknowledge that once I start using the platform I lose my right of withdrawal.”

We record consent version (2026-06-13-v1), timestamp, and transaction ID.

4. If consent is not given

We do not activate platform access until the 14-day period expires or until explicit consent is given — as required by applicable law.
